Scope of this Policy

This privacy policy applies to:

  • Frame By Frame Animacion and our affiliates (“FBF Animacion,” “we,” “us,” “our”). 
  • FBF Animacion’s online properties (including our websites and websites or mobile applications that link to it), our social media pages or handles, our products and services (the “Services”).

This Policy applies when you interact with us through our Services. It also applies anywhere it is linked. It does not apply to third-party websites, mobile applications, or services that may link to the Services or be linked to from the Services. Please review the privacy policies on those websites and applications directly to understand their privacy practices.

We may change this Policy from time to time. If we do, we will notify you by posting the updated version. 

Information We Collect 

We collect information from you directly, from the devices you use to interact with us, and from third parties. We may combine information from the Services together and with other information we obtain from our business records. We may use and share information that we aggregate (compile to create statistics that cannot identify a particular individual) or de-identify (strip information of all unique identifiers such that it cannot be linked to a particular individual) at our discretion.

Information you give us

You may provide the following information to us directly:

  • Contact information, including name, email address, telephone number, and company name.
  • Demographic information.
  • Audiovisual information, including recordings of online events.
  • Payment information, including credit card information, is processed by our service provider, Stripe, and is not stored by FBF Animacion.
  • Content you may include in survey responses.
  • Information contained in your communications to us, including messages sent to us via the WhatsApp application and call recordings of customer service calls.
  • Information you make available to us via a social media platform.
  • Any information or data you provide by interacting in our online forums and chatrooms, or by commenting on content posted on our Services. Please note that these comments are also visible to other users of our Services.
  • Information regarding your course selection and progress.
  • Information you submit to inquire about or apply for a job with us.
  • Any other information you submit to us.

Information we collect automatically

We and partners working on our behalf may use log files, cookies, or other digital tracking technologies to collect the following information from the device you use to interact with our Services. We also create records when you make purchases or otherwise interact with the Services.

  • Device information, including IP address, device identifiers, and details about your web browser.
  • Analytical information, including details about your interaction with our website, app, and electronic newsletters.
  • Diagnostic information, including web traffic logs.
  • Advertising information, including special advertising and other unique identifiers that enable us or third parties working on our behalf to target advertisements to you. Information We Collect From Other Sources

We may collect the following information about you from third-party sources.

  • Contact information, demographic information, and information about your interests and purchases, from consumer data providers.
  • Information about your interests, activities, and employment history from social networks and other places where you choose to share information publicly. 
  • Information about your interaction with advertisements on our Services, or ads that we place on third party websites, from online advertising companies.
  • If you decide to invite others to the Services, we will collect your and the other person’s names, email addresses, and/or phone numbers to send an email or text message and follow up with the other person. You agree that you will obtain the other person’s consent before giving us his or her contact information. You also agree that you will not send us the contact information of a minor. We will inform any other person you invite that you gave us his or her information in the invitation email.

How We Use Your Information

We may use any of the information we collect for the following purposes.

  • Service functionality: To provide you with our products and services, including to take steps to enter a contract for sale or for services, process payments, fulfill orders, send service communications (including renewal reminders), and conduct general business operations, such as accounting, recordkeeping, and audits.
  • Service improvement: To improve and grow our Services, including to develop new products and services and understand how our Services are being used, our customer base and purchasing trends, and the effectiveness of our marketing.
  • Personalization: To offer you recommendations and tailor the Services to your preferences.
  • Advertising and marketing: To send you marketing communications, personalize the advertisements you see on our Services and third-party online properties, and measure the effectiveness of our advertising. We may share your information with business partners, online advertising partners, and social media platforms for this purpose.
  • Security: To protect and secure our Services, assets, network, and business operations, and to detect, investigate, and prevent activities that may violate our policies or be fraudulent or illegal.
  • Legal compliance: To comply with legal process, such as warrants, subpoenas, court orders, and lawful regulatory or law enforcement requests and to comply with applicable legal requirements.

How We Share Your Information

We may share any of the information we collect with the following recipients.

  • Affiliates: We share information with other members of our group of companies.
  • Service providers: We engage vendors to perform specific business functions on our behalf, and they may receive information about you from us or collect it directly. These vendors are obligated by contract to use information that we share only for the purpose of providing these business functions, which include: 
    • Supporting Service functionality, such as vendors that support event registration, customer service and customer relationship management, subscription fulfillment, freight services, application development, list cleansing, postal mailings, and communications (email, fax).
    • Auditing and accounting firms, such as firms that assist us in the creation of our financial records.
    • Professional services consultants, such as firms that perform analytics, assist with improving our business, provide legal services, or supply project-based resources and assistance.
    • Analytics and marketing services, including entities that analyze traffic on our online properties and assist with identifying and communicating with potential customers. 
    • Security vendors, such as entities that assist with security incident verification and response, service notifications, and fraud prevention.
    • Information technology vendors, such as entities that assist with website design, hosting and maintenance, data and software storage, and network operation.
    • Marketing vendors, such as entities that support distribution of marketing emails.
  • Business partners: From time to time, we may share your contact information with other organizations for marketing purposes. 
  • Online advertising partners: We partner with companies that assist us in advertising our Services, including partners that use cookies and online tracking technologies to collect information to personalize, retarget, and measure the effectiveness of advertising. 
  • Social media platforms: If you interact with us on social media platforms, the platform may be able to collect information about you and your interaction with us. If you interact with social media objects on our Services (for example, by clicking on a Facebook “like” button), both the platform and your connections on the platform may be able to view that activity. To control this sharing of information, please review the privacy policy of the relevant social media platform.
  • Government entities/Law enforcement: We may share information when we believe in good faith that we are lawfully authorized or required to do so to respond to lawful subpoenas, warrants, court orders, or other regulatory or law enforcement requests, or where necessary to protect our property or rights or the safety of our employees, our customers, or other individuals. 
  • Other businesses in the context of a commercial transaction: We may change our ownership or corporate organization while providing the Services. We may transfer to another entity or its affiliates or service providers some or all information about you in connection with, or during negotiations of, any merger, acquisition, sale of assets or any line of business, change in ownership control, or financing transaction. We cannot promise that an acquiring party or the merged entity will have the same privacy practices or treat your information as described in this policy.

Security

We use a combination of physical, technical, and administrative safeguards to protect the information we collect through the Services. While we use these precautions to safeguard your information, we cannot guarantee the security of the networks, systems, servers, devices, and databases we operate or that are operated on our behalf.

Your Options and Rights Regarding Your Information

Email Unsubscribe: If you do not wish to receive marketing information from us or wish to opt out of future email promotions from us, please contact us. Please note that all promotional email messages you receive from us will include an option to opt out of future email communications.

Ad Choices: You have options to limit the information that we and our partners collect for online advertising purposes.

  • You may disable cookies in your browser or mobile device using their settings menus. Your mobile device may give you the option to disable advertising functionality. Because we use cookies to support Service functionality, disabling cookies may also disable some elements of our online properties.

If you exercise these options, please be aware that you may still see advertising, but it will not be personalized. Nor will exercising these options prevent other companies from displaying personalized ads to you.

Do Not Track: Your browser or device may include “Do Not Track” functionality. The information collection and disclosure practices and the choices that we provide to you will continue to operate as described in this privacy policy regardless of whether a Do Not Track signal is received.

Special Information for Job Applicants

When you apply for a job with us, we may collect information from you, including: 

  • Information you provide in connection with your application. 
  • Information that you make available in your social media accounts. 
  • Information about you that is available publicly. 
  • Information that you authorize us to collect via third parties, including former employers or references. 

In certain circumstances, you may submit your application for employment through a third-party service that displays our job posting. We do not control the privacy practices of these third-party services. Please review their privacy policies carefully prior to submitting your application materials.

We may store information about you for as long as we have a legitimate business need for it. 

Cross-border data transfer

We may collect, process, and store your information in the United States and other countries. The laws in the United States regarding information may be different from the laws of your country. Any such transfers will comply with safeguards as required by relevant law. 

Information about children

With appropriate parental consents, children under thirteen years of age are permitted to use our website to register and participate in courses. This section of our privacy policy applies to children under thirteen years of age using our Services. We provide this notice to inform parents and legal guardians (collectively or alternatively “parents” or “parent”) of:

  • The types of information we may collect from children through their use of our Services;
  • How we use the information collected;
  • Our practices for sharing that information;
  • Our practices for notifying and obtaining parental consent when we collect personal information from children, including how a parent may revoke consent; and
  • All entities that collect or maintain information from children through our Services.
  • What kinds of information do we collect from children through our Services?

Personal information, as used here, includes any information considered to be “personal information” under the Children’s Online Privacy and Protection Act (“COPPA”) and its implementing regulations, as they may be amended from time to time, including geolocation information and persistent identifiers that can be used to recognize a user over time and across different websites or online services.

Children can access and use parts of our website without providing us with personal information. We do not knowingly collect, store, use or disclose any personal information from children through our website without first notifying and obtaining the express consent of a parent, other than collecting the limited personal information necessary to obtain parental consent, as described in Section 4 below.

After parental consent is provided, a child must provide us with the following personal information to register for classes on our website:  (1) the child’s first and last name; and (2) his or her email address. The child will also be required to provide us with the zip code where he or she resides.   

We may also passively collect certain information from a child when he or she accesses, navigates, and use our Services.  For example, we may collect information about the type of browser a child is using, the operating system on a child’s computer or device, the domain name of a child’s Internet service provider, and/or the child’s IP address or mobile device identifier.  We will not, however, use persistent identifiers to recognize a child over time and across different websites or online services, without first notifying and getting consent from a parent. We may combine non-personal information collected through these passive technologies with personal information provided by your child, after obtaining parental consent.

1. How Do We Use Information Collected from Children Through our Services?

We may use the personal information (and non-personal information) of a child that we collect to support our internal operations, and, with a parent’s consent: (1) to process and track the child’s progress; (2) to operate and improve our Services; (3) to respond to a child’s comments and questions, and provide customer service; (4) to send a child information related to the course registration, including confirmations, updates, support, administrative notices, and, in our discretion, updates to our Services policies and procedures; (5) to conduct research and analyses to address the performance of our Services; and/or (6) for purposes disclosed at the time the child provides his or her information or as otherwise set forth in the general Privacy Notice or this section of the Privacy Notice.

2. How Do We Share Personal Information Collected from Children Through our Services?

(a) No Third-Party Marketing Purposes.  We will not rent, sell or otherwise disclose a child’s personal information to advertisers, sponsors, business partners and other third parties for their use to directly market to the child.

(b) Third Parties Providing Services on Our Behalf.  We may use third-party vendors to perform certain aspects of our Services.  This may include hosting the Services, designing and/or operating our Services’ features, tracking our Services’ analytics, processing course registrations, or performing other administrative services.  We may provide these vendors with access to user information, including a child’s personal information, to carry out the services they are performing for the child or for us.  These third-party vendors have access to the personal information needed to perform their functions and are contractually obligated to maintain the confidentiality and security of that personal information. In addition, while we may use third-party analytics service providers to evaluate and provide us with information about the use of the Services and viewing of our content, we do not share personal information with these analytics service providers.  However, they may set and access their own cookies, web beacons and embedded scripts on the child’s device and they may otherwise collect or have access to information about the child, including non-personal information.  

(c) Administrative and Legal Reasons.  To the extent we retain children’s personal information, we may access, use, preserve, transfer and disclose a child’s personal information, including disclosure to third parties, if in our good faith belief, it is required: (i) to comply with or satisfy any applicable law, regulation, subpoenas, governmental requests or legal process if in our good faith opinion such is required or permitted by law; (ii) to protect and/or defend the Terms of Use for our Services or other policies, including investigation of potential violations thereof; (iii) to protect the safety, rights, property or security of FBF Animaction, any third party person or entity, or the public (including under emergency circumstances); and/or (iv) to detect, prevent or otherwise address fraud, security or technical issues.  Further, we may use IP address or other device identifiers to identify users, and may do so in cooperation with third parties such as copyright owners, Internet service providers, wireless service providers and/or law enforcement agencies, including disclosing such information to third parties, all in our discretion.  Such disclosures may be carried out without notice to the child or parent.

(d) Business Transfer.  We may share a child’s information, including the child’s personal information, demographic information and usage information with our parent, subsidiaries and affiliates for internal reasons.  We also reserve the right to disclose and transfer all such information: (i) to a subsequent owner, co-owner or operator of the website or applicable database; or (ii) in connection with a corporate merger, consolidation, restructuring, the sale of substantially all of our membership interests and/or assets or other corporate change, including, during the course of any due diligence process.

3. How Do We Notify and Get Consent from a Parent to Collect a Child’s Personal Information Through our Services?

When a child requests to register for a course on our Services, we follow this “Parental Notice and Consent Process”:

  • We ask the child to supply their month and year of birth, email address and an email address for a parent.
  • We will send an email (at the supplied email address) to directly notify the parent of the child’s request to register for a course via our website, and describe the personal information that we intend to collect from the child in connection with his or her use of our Services.  
  • The parent will have the opportunity to consent (or not) to our collection and use of the child’s personal information by following a URL link provided in the body of the email or sending a reply email to [email address]. If the parent chooses to provide consent, at a later time, we will send another message via the parent’s online contact information to confirm the consent, and inform the parent how they can revoke the consent if they later choose to do so.
  • If the child’s use of our Services requires disclosure within the meaning of COPPA of children’s personal information, consent specific to that activity and its related disclosure will be obtained from the parent via a consent form signed by the parent and returned to FBF Animacion by postal mail, facsimile, electronic scan, or equivalent means.

By giving consent, a parent:  (i) agrees that the child’s activities on our Services are subject to the Terms of Use for our websites or services; and (ii) consents to our storage and use of personal information collected from the child as described in our general Privacy Notice and this section of our Privacy Notice.   As described below, we make special provisions to allow parents to control the personal information submitted by and collected from children.

If a parent does not give consent to collection of personal information, the child’s and parent’s email addresses will be deleted within 24 hours.  The child will still be able to browse and view content on our website, but we will not collect personal information from the child.

4. How Can a Parent Review, Change or Delete Personal Information Collected from Children Through our Services?

Parents have the right to review all personal information about children collected by us through our Services, can ask us to delete the personal information, and can refuse to permit us to collect or use a child’s personal information in the future.  If a parent wishes to review a child’s personal information, or ask us to delete that personal information, you may send us a letter to the postal address below, or email us at [email address].  If you contact us via email, please include “Review Child’s Information” in the subject line of your email. Note that we may require that the parent provide us with personal information in a good faith effort to confirm the parent’s identity and relationship to a child prior to providing access to their child’s personal information. 

5. How Will We Notify Parents if This Privacy Notice Changes?

We may amend this Privacy Notice from time to time.  We will provide parents notice by e-mail of any material changes in the way we intend to collect or use children’s personal information, and will seek additional consent, to the extent necessary, for any disclosure of their children’s personal information.  Please note that, at all times, parents should update their contact information to provide us current email addresses.  Parental contact information may be updated by contacting us at [email address].  We will apply material changes to this Privacy Notice only in conformance with applicable law, including any applicable provisions of COPPA that require parental consent.

California residents are entitled once a year, free of charge, to request and obtain certain information regarding our disclosure, if any, of certain categories of personal information to third parties for their own direct marketing purposes in the preceding calendar year.
